 The Utilization of free speech: A discussion on the First Amendment of the U.S.


Despite its exalted status, the First Amendment of the U.S has always been the subject of controversy in practice. The First amendment protects the freedom of Speech of all citizens. While on the face this may seem perfect and flawless and a true upholding of the citizens rights, behind the curtain this has been the subject to a lot of scrutiny. What seems to be the problem is the First Amendment’s protection of “hate speech,”. Due to this inclusion of hate speech, Critics believe that freedom of speech in practice has become a tool of oppression, one that leads to physical violence.

A Vivid Example of this is the events that took place on 6 January, 2021 i.e is when the battery of staunch Trump supporters stormed the Capitol Building. The Violent riots that left many injured and 5 people dead, started essentially with the hate speech and spread of ultra rightest propaganda on the Social Media platforms.

So where does the problem arise from? The First amendment is one of the most liberal fundamental rights. Even in India itself, there have been restrictions put on the freedom of speech.




" The Constitution guarantees freedom of speech and expression. But this freedom is subject to reasonable restrictions imposed I by the State relating to a) Defamation; b) Contempt of Court; c) Decency or morality; d) Security of the State; e) Friendly relations with foreign State; f) incitement to an offence; g) public order; h) Maintenance of the sovereignty and integrity of India."


In Comparison, there are almost no restrictions on the freedom of Speech in the U.S. But that means that there also not a curb on the Hate speech, speech that promotes violence and propagates divide and inferiority of certain sections of society.

The biggest problem is that hate speech defies a clear and consistent definition, let alone a workable legal standard. With no consistent definition of hate speech, The first amendment can't be amended.


The First Amendment of US is more than 230 year old. It is time that we discuss as to how it can be amended. For that it is imminent that we start working to build a working definition of hate speech.

Secondly, it is important that we promote Education, especially on media ethics as it will help Counter hate speech.

There is a need to encourage conflict-sensitive reporting and multicultural awareness campaigns as they might help dispel the ‘us’ against ‘them’ prejudice. We can do this by-

Teaching journalists conflict-sensitive reporting skills.


Multicultural awareness campaigns should emphasize knowledge about and respect for the diversity of cultures and tradition
There is a need to end impunity against hate crime by establishing monitoring and evaluation units in newsroom units that would monitor hate speech trends, compile reports, and bringing these to the attention of key institutions and society. Action can then been taken accordingly.

We need to engage in advocacy to highlight hate speech trends of concern as well as to express sympathy and support to targeted individuals or groups.

We need to encourage conflict-sensitive reporting and multicultural awareness campaigns as they might help eliminate the ‘us’ against ‘them’ bias. We can do this by-

1) Creating a special education curriculum wherein students are taught about equality and unity in diversity.

2)Teaching journalists conflict-sensitive reporting skills.

3)Multicultural awareness campaigns should emphasize knowledge about and respect for the diversity of cultures and traditions
